Unauthorized Practice

This is the 2007 final report prepared by a subcommittee of the Colorado Bar Association (CBA) ADR Section on the Unauthorized Practice of Law and Mediation. The committee consists of Samuel Gordon, Susan Demidovitch, Cynthia Savage, Anthony Van Westrum, James Coyle and Mike Ruderman. This report has been worked on for two years and is in its final form and now being submitted to the CBA Executive Council.

While this report does not have the force of law, following the advice contained within should help non-lawyer mediators avoid the probability of being liable for the unauthorized practice of law while engaging in appropriate mediation conduct.

Code of Conduct

The Colorado Council of Mediators ("CCMO") has adopted the August 2005 Model Standards of Conduct for Mediators prepared by the Joint Committee initiated by the American Arbitration Association, the American Bar Association’s Section of Dispute Resolution and the Association for Conflict Resolution.. CCMO gratefully acknowledges the work of this group.

CCMO produces an annual Mediation Resource Guide that contains information on interest to mediators and to those considering joining the mediation field. Included are the following:

  • General information on the field of mediation, where it is used, making a living as a mediator, and training;
  • Recommended guidelines for mediation education and training;
  • Organizations that offer mediation training in Colorado;
  • Organizations that offer mediation internships as well as administrative internships in ADR management;
  • Organizations which use volunteer mediators;
  • Lists of Journals, periodicals, and books related to mediation and conflict resolution; and
  • National business and professional organizations related to conflict resolution.
