CONCENTRATION

Mediation/arbitration of complex commercial transactions, HOA disputes, insurance subrogation, collection and breach of contract actions.

SUMMARY

Thirty years’ experience in litigation related to construction defects, standards of care, contract, landlord/tenant, and other related actions allows me to facilitate the resolution of intricate cases from a knowledgeable and logical business-oriented perspective. This approach to the mediation field has proven to be a particularly efficient and cost effective means of resolving monetary disputes and other civil matters, when time is of the essence and the ability to quickly identify and resolve the key issues is paramount.

BIOGRAPHY

With experience negotiating and closing complex real estate transactions between and among the public and private sectors since 1983, I bring to my mediation practice a superior record of accomplishment in creating mutually beneficial solutions, with particular expertise in sensitive environments. I have worked with local government agencies in five states and have called upon my multilingual expertise to facilitate foreign development interests. I have an incisive ability to anticipate and assess the goals and concerns of construction, commerce and real estate development related conflict.

In 1996, I successfully mediated a quadripartite agreement in a highly charged political environment with the City and County of Denver, a multi-national real estate company and local neighborhood associations, receiving Denver Metropolitan Commercial Association of Realtors “Transaction of the Year” Award. I have extensive experience in litigation management relating to various contract, employment, landlord/tenant and HOA disputes, lender liability, asbestos abatement and standards of care, allowing me to facilitate the resolution of complicated disputes from a knowledgeable and logical business-oriented perspective.

My approach to the mediation field has proven to be a particularly efficient and cost effective means of resolving monetary disputes, when time is of the essence and the ability to quickly identify the key issues is paramount. Since 2009, I have mediated over 1,000 cases consisting of a broad spectrum of matters relating to transactional, construction, domestic relations, homeowners association, insurance subrogation, landlord/tenant and other real estate disputes.

As the result of an active pro bono caseload, I was honored by Jefferson County Mediation Services as the 2009 New Volunteer Mediator of the Year, 2010 Most Pro Bono Hours Dedicated and Most Total Cases Mediated, 2011 Small Claims and County Court Mediator of the Year and 2012 Permanent Protection Order Mediator of the Year.  Having also completed extensive domestic violence training, I have mediated in temporary and permanent protection order hearings, along with other actions in District and County Courts throughout Colorado.

PUBLIC SERVICE

2013-2015: I served on the Littleton City Council as the District 1 Representative, was a Member of the Board of Directors of the Denver Regional Council of Governments, and a member of the South Platte Working Group; tasked with the transformation and revitalization of the river as it passes through Arapahoe County.  I am an alumnus of the Denver Transit Alliance Academy; educating both the public and private sectors regarding transit oriented development throughout the Front Range. 

I currently serve on the Legislative Committee of the Mediation Association of Colorado, in which capacity I have been working with the HOA Information Officer at the Colorado Department of Regulatory Agencies (“DORA”) to promote the utilization of mediation in HOA disputes.   I am a registered lobbyist for the General Assembly of the State of Colorado, where I am working with legislators from both sides of the aisle to effect positive reform in land use and construction defect legislation, as well as the prospective credentialing and monitoring of mediators who undertake the mediation of Court Referred matters.
